Dispute Resolution

How do you stand with HMRC?

Many tax payers want to take a proactive position with HM Revenue & Customs in order to clear historical tax liabilities and/or obtain tax treatment certainty.

Others are in a position where Customs have issued an adverse decision and need support in resolving the situation.

Tax payers have the right to dispute a wide range of decisions made by Customs. This right may be exercised by requesting that Customs review a decision it has issued and/or by initiating appeal proceedings at UK VAT and Duties Tribunals.

Accordance can help by examining a company's potential and actual areas of dispute with Customs. We can advise on how best to avert a dispute before it arises and help to resolve it once it has arisen with minimum disruption to your business.

Customs Rulings

Where there is justified legal doubt as to the correct VAT treatment for a particular trading activity or VAT recovery situation, a ruling letter from Customs can protect the taxpayer from assessments and/or penalties. Accordance can help you obtain such a ruling. Why run the risk of a later large assessment and penalties?

Negotiations

Where Customs have issued an adverse decision, we can guide a company through the negotiation process to ensure it puts forward its best legal, technical and evidential arguments in support of its case.

We can also help with obtaining a 'global' settlement - where Customs are prepared to negotiate with tax payers a mixture of past errors as well as Customs errors. Historical problems are rectified and the parties are able to start afresh for the future.

Review Processes

A tax payer has the right to request that Customs carry out a local review of an adverse decision. There are strict and short time limits for submitting a request for review. Accordance can help you through the review process.

Tribunal Proceedings

Tax payers may appeal adverse decisions to the VAT and Duties Tribunals.

We provide the full range of support in Tribunal proceedings: advise on the strength of an appellant's case; prepare appeal documentation; brief Counsel; and provide advocacy on your behalf at Tribunal.
